Make the Cut Mobile Application

Effective Date: July 1, 2026

Please read these Terms of Use (“Terms”) carefully before using the Make the Cut mobile application (“App”) operated by Sunjai Williams and Make the Cut (“we,” “us,” or “our”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using the Make the Cut App, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be legally bound by them. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of the App

Make the Cut is a fan membership platform that provides subscribers with exclusive access to content, dance challenges, cash giveaway opportunities, real-world experiences, events, and other features associated with Sunjai Williams. The App offers both a free tier and a paid subscription tier. Certain features and content are only accessible to active paid subscribers.

3. Account Registration

3.1.  You must create an account to access certain features of the App. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2.  You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.3.  You must notify us immediately of any unauthorized use of your account.

3.4.  We reserve the right to suspend or terminate accounts that contain false or misleading information or that violate these Terms.

3.5.  You may not create more than one account per person. Duplicate accounts may be removed without notice.

4. Subscriptions & Payments

4.1.  Make the Cut offers a paid subscription at the following rates: Monthly at $5.99 per month, or Annual at $30.99 per year.

4.2.  Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

4.3.  Payments are processed through Apple App Store or Google Play Store in-app purchase systems. All billing is governed by the terms of the applicable platform.

4.4.  Subscription fees are non-refundable except as required by applicable law or platform policy.

4.5.  We reserve the right to change subscription pricing at any time with reasonable notice to users.

4.6.  A free account does not entitle you to subscriber-only features, content, or giveaway participation.

5. User Conduct

By using the App, you agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

  • Attempt to gain unauthorized access to any portion of the App or its related systems

  • Upload or transmit any content that is defamatory, obscene, offensive, or harmful

  • Interfere with or disrupt the integrity or performance of the App

  • Use automated tools, bots, or scripts to access or interact with the App

  • Share, resell, or transfer your account or subscription to another person

  • Use the App to harass, bully, or harm other users

6. Content

6.1.  All content available through the App, including but not limited to videos, images, text, dance challenges, and audio, is owned by or licensed to Make the Cut and is protected by applicable intellectual property laws.

6.2.  Subscriber-only content, including monthly dance challenge videos, may not be shared, downloaded, recorded, redistributed, or made accessible to non-subscribers in any form.

6.3.  You are granted a limited, non-exclusive, non-transferable license to access and view content through the App for personal, non-commercial purposes only.

6.4.  We reserve the right to modify, remove, or discontinue any content at any time without notice.

7. SMS Notifications

7.1.  By providing your phone number and opting in to SMS notifications, you consent to receive text messages from Make the Cut regarding app updates, live events, giveaways, and other relevant communications.

7.2.  Message and data rates may apply. Message frequency varies.

7.3.  You may opt out of SMS notifications at any time by replying STOP to any message or by updating your notification preferences in the App.

7.4.  Opting out of SMS notifications does not cancel your subscription.

8. Third-Party Services

The App may contain links to or integrations with third-party services including TikTok, Instagram, Facebook, Google Maps, and Shopify. We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their respective terms and policies.

Make the Cut relies on third-party platforms and services to deliver notifications, including but not limited to Apple Push Notification Service (APNs), Google Firebase Cloud Messaging (FCM), and Twilio SMS. We are not responsible for notifications that are delayed, undelivered, or not received due to the actions, outages, limitations, or policies of these third-party services. It is the responsibility of each user to ensure their device settings permit notifications from the App and that their contact information on file is accurate and current. Failure to receive a notification for any reason does not extend entry deadlines, alter winner selection, or create any obligation on the part of Make the Cut.

9. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any content available through the App.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Make the Cut, Sunjai Williams, and their respective affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of revenue, or personal injury, even if advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for your subscription in the three months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Make the Cut, Sunjai Williams, and their respective affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of any third party.

12. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Hinds County, Mississippi.
